Terms and conditions of Swing-It online shop

Preliminary provisions
1. Online shop for Swing It, available at the Internet address www.swing-it.eu, is run by Grzegorz Londo established under the name Grzegorz Londo Swing It, entered in the central registration and information on Economic activity (COMPANY REGISTRATION CERTIFICATE) by the competent Minister of the economy, NIP 8681617101 REGON 380141631.
2. This regulation is aimed at consumers and defines the principles and the conclusion of a consumer contract of sale at a distance through the store.

Definitions
1. The consumer -natural person containing the seller agreement within the store, the item is not associated directly with their business or professional activity.
2. The seller – a natural person established under the name Grzegorz Londo Swing It, entered in the central registration and information about the business (COMPANY REGISTRATION CERTIFICATE) by the competent Minister of economy, NIP 8681617101 REGON 380141631.
3. The client -any entity who purchases through the store.
4. Entrepreneur -the natural person, legal person or organizational unit is not a legal person, which separate the law recognizes the legal capacity, carrying out on behalf of a business that uses the store.
5. Shop -online store run by the seller under the Internet address www.swing-it.eu
6. A contract concluded at a distance -the agreement concluded with the client as part of a structured system to conclude distance contracts (in the shop), without the simultaneous physical presence of the parties, the exclusive use of one or more means of distance communication to the time of conclusion of the contract.
7. Terms and conditions – these terms and conditions.
8. Order -Declaration of the customer’s will to buy a product or products submitted by using the order form
9. Account -customer’s account in the store, it collects data provided by the customer and information about the submitted Orders.

11. Order form -an interactive form available at the store for ordering, in particular by adding Products to your shopping cart and to specify the conditions of the contract of sale, including the way of delivery and payment.
12. Shopping cart – element of the store where selected Products are visible, also allowing of fixing and modifying the order data, in particular the quantities of products.
13. Product – available in Store for mobile/service which is the subject of the contract of sale between the customer and the seller.
14. The Contract Of Sale – the contract of sale of the product made or concluded between the customer and the seller via the online shop.

General information
1. Seller to the fullest extent permitted by applicable law, shall not be liable for disruptions or interruption in the functioning of the Store due to force majeure, unauthorized action of third parties or the incompatibility of the store the client’s Internet technical infrastructure.
2. Browsing the store does not require creating an account. Placing orders by the customer for the products in the store is possible either with an active account in accordance with the provisions of part 6 of the rules or by specifying the necessary personal data and addresses to order without creating an account.
3. The prices listed in the store are given in Polish zloty and are gross prices (include VAT). Functionality of the store allows to show prices in EUR. The price does not include customs duties if any. The payment of the duty lies with the customer.
4. On the final (final) amount to be paid by the client consists of the price for the product and the cost of delivery (including transport, delivery and postal services), for which the customer is informed on the website in the course of the order, and is shown before confirming the payment.
5. In the case of a contract which includes a subscription or the provision of services for an indefinite period (final) price is the total price including all payments for the tax period.
6. When the nature of the subject matter of the contract does not allow reasonably believing the previous calculation of the amount of the final (final) prices, information on the manner in which the price is calculated, as well as fees for transportation, delivery, postal services and the other costs, to be specified in the product description.

Creating an account in the store
1. To set up an account in the store, you must fill in the registration form. It is necessary to provide the following data: first name, last name, address, delivery address (if different), telephone, email address.
2. Set up an account in the store is free.
3. Login to your account is done by entering login and password established in the registration form.
4. The customer has the option at any time, without cause and without incurring the charge remove the account by sending the relevant request to the seller, in particular via e-mail or in writing to the addresses of the given in section 3.

Ordering policies
To place an order:
1. log on to the store (optional);
2. Select the product which is the subject of the order, and then click the “add to cart”;
3. log in or choose to place an order without registering;
4. If you selected the option to place an order without registering – check out your cart content, enter the delivery address choose the shipping mode (if free shipping is unlocked), enter coupon code if you have one. At this point you can still add or remove products in your cart and confirm by using “Update cart” button.

Delivery and payment methods
1. The client can use the following methods of delivery of the ordered product:

The performance of the contract of sale
1. The conclusion of the contract of sale between the customer and the seller follows after placing Order using the order form in the online store according to section 7 of the Terms and Conditions.
2. After placing an order, Seller shall acknowledge its receipt and at the same time accepts the Order for execution. Confirmation of receipt of the order and its adoption to implementation by sending confirmation e-mail to Client’s e-mail address.
3. The client is obliged to make the payment within 3 working days from the date of conclusion of the contract of sale, otherwise the order will be cancelled.
4. If the customer chose a shipping method other than local pickup, the product will be sent by the seller within 3 business days after receiving the payment in the manner chosen by the customer when placing the the order.
5. Product delivery takes place within the European Union and other countries listed in the “Shipping” on the shop website.
6. Delivery of the product to the customer is paid, unless the sale agreement provides otherwise. Costs of delivery of the product (including transport, delivery and postal services) are indicated to the customer on the online store when placing the order, including in time by the client will bind to the contract of sale. In case the customer is entitled to Free Shipping, the appropriate checkbox should be marked before placing the order.

The right to withdraw from the agreement
1. The consumer can within 14 days to withdraw from the sales contract without giving any reason.
2. The period referred to in paragraph 1, starts with the delivery of the Product to the consumer or designated by him to a person other than the carrier.
3. The consumer may withdraw from the contract, by presenting the seller a statement of withdrawal from the contract. To meet the deadline of withdrawal it is sufficient to send a claim by the consumer before the expiry of that period.
4. The claim may be sent via postal mail, or electronically by sending to the email address of the seller. A statement can be made also on the form, a specimen of which is given in annex the annex to the Act of May 30, 2014 year on consumer rights, but it is not mandatory.
5. If you send a statement by the consumer by electronic means, the seller shall immediately send to the Consumer’s e-mail address confirmation of receipt of the Declaration of withdrawal from the agreement.
6. Effects of withdrawal from the contract:
1. In case of withdrawal from the contract concluded at a distance Contract shall be considered null and void.
2. In the event of cancellation of the contract the seller returns the consumer immediately, not later than within 14 days from the date of receipt of the statement of the consumer to withdraw from the contract, all amount paid, including the cost of delivery of the things with the exception of additional costs arising from the selected by the consumer how to provide other than the cheapest regular delivery method offered by the seller.
3. The seller will make a payment using the same payment methods that have been used in the original transaction by the consumer, unless the consumer expressly agreed otherwise, that do not produce for him with any costs.
4. The seller may withhold the reimbursement until receiving the product back or deliver proof of his return, depending on which event comes first.
5. The consumer should return the product to the seller’s address specified in these terms and conditions immediately, not later than 14 days from the date on which the reported the seller to withdraw from the contract. The deadline will be met if the consumer sends the product before the expiry of 14 days.
6. The consumer shall bear the direct cost of returning the Product, the costs of returning the product, if due to its nature, this product could not be normally sent by mail.
7. The consumer is responsible only for a reduction in the value of the product resulting from the use of it in a different way than it was necessary to establish the nature, characteristics and functioning of the product.
9. Where, by reason of the nature of the product can not be returned in the ordinary course of mail, information, as well as the costs of returning the product, will be in the description of the product in the store.

Claims & warranty
1. The shop offers only new products.
2. The seller is obliged to deliver products free from defects.
3. In the case of a defect of the purchased from a reseller of goods the customer has the right to complaint on the basis of the provisions concerning warranty in the civil code.
4. The complaint must be reported in writing or electronically to the seller’s addresses provided in this terms and conditions.
5. It is recommended that the complaint conclude a brief description of the defect, the circumstances (including the date) the instance data of the complaining Client, and the client request due to a defect of the goods.
6. Seller will respond to the complaint request immediately, not later than within 14 days, and if doesn’t within that time limit, the client request will be considered as justified.
7. Goods sent back in the procedures for complaints should be sent to the address specified in section 3 of this regulation.

Out-of-court ways to handle complaints and redress
1. Detailed information on the use by the consumer of the out-of-court complaint and redress and access to these procedures are available in the offices and on the websites of District (municipal) consumer advocates, social organizations, to which statutory tasks include consumer protection, the provincial inspectorates of trade inspection and at the following Internet address Office of competition and consumers: http://www.uokik.gov.pl/spory_konsumenckie.php; http://www.uokik.gov.pl/sprawy_indywidualne.php and http://www.uokik.gov.pl/wazne_adresy.php.
2. The consumer has the following examples of the use of the out-of-court complaint and redress:
1. The consumer is entitled to ask the amicable consumer Court, as referred to in article 37 of the Act of 15 December 2000 on trade inspection (OJ of 2014 r. poz. 148 as amended), with the request to settle the dispute arising from the contract concluded with the seller.
2. The consumer is entitled to ask the provincial inspector of trade inspection, in accordance with article 36 of the law of 15 December 2000 on trade inspection (OJ of 2014 r. poz. 148 as amended), with the request to initiate mediation proceedings in on an amicable end to the dispute between the consumer and the seller.
3. The consumer can get free help on the settlement of the dispute between it and the seller, including free assistance of district (municipal) consumer advocate or social organization, to which statutory tasks include consumer protection (m.in. Federation Of Consumers, Consumer Association Of Polish).

Personal data in the online store
1. The administrator of the personal data collected via the online shop is the seller.
2. Personal data collected by the administrator via the online shop are collected in order to carry out the agreement of sale, and if the customer gives his consent-also for marketing.
3. Recipients of personal online store can be:
– In the case of a client that uses an online store with the method of delivery by post or by courier service, the Administrator provides the collected personal data to the selected carrier or intermediary performing on behalf of the administrator.
– In the case of a client that uses an online store with the payment method or credit card Administrator provides the collected personal data of the client, to the selected entity providing the payments in the online store.
4. The client has the right to access their personal data and correct them.
5. Providing personal data is voluntary, but lack of consent to provide personal data results in the inability to perform a sales contract

Final provisions
1. Contracts concluded through the online shop are in the English language.
2. The seller reserves the right to make changes to terms and conditions for important reasons this is: changes in laws, changes in payment methods and delivery – in so far as these changes affect the implementation of the provisions of this regulation. The seller shall inform the customer of any change at least 7 days in advance.
3. In matters not regulated by these terms and conditions apply generally applicable Polish law provisions, in particular: the civil code; the Act on electronic services; consumer rights act, the Act on the protection of personal data.
4. The customer has the right to use the out-of-court complaint and redress. For this purpose, can make a complaint via the EU’s Internet platform ODR available at: http://ec.europa.eu/consumers/odr/ .
